Terms and Conditions

Displays, LLC d/b/a Displays Fine Art Services, together with its affiliates, subsidiaries, divisions, officers, employees and agents are collectively referred to herein as “Displays Fine Art Services.”

General Terms

Accessibility: All estimates are based on dock/ground floor/easy access upon origin and destination unless otherwise noted. Any unknown obstacles, restricted access, stairs, additional services, and other delays will incur additional charges.

Additional Services: Displays Fine Art Services will not be responsible for any special services not expressly written unless agreed to in advance in writing. Special services requested by Client and agreed upon by Displays Fine Art Services shall be subject to additional charges.

Couriers: Designated trucks are courier friendly and include a bed, clean bedding, refrigerator use, TV, and charging stations. Any smoke or pet allergies need to be provided at the time of booking.

Estimates: ESTIMATES ARE NOT A CONFIRMATION OF BOOKING AND DO NOT INCLUDE TRANSIT INSURANCE UNLESS OTHERWISE NOTED. ALL ESTIMATED PRICES ARE BASED UPON INFORMATION PROVIDED AT THE TIME OF QUOTE AND ARE SUBJECT TO CHANGE. Any additions or subtractions to provided information will void any estimate, and a new estimate will need to be submitted. Estimates are based on work to be performed during Displays Fine Art Services normal business hours. Work performed outside of normal business hours shall be subject to additional charges. Estimates are valid for 1 month from the DATE PROVIDED except for prices associated with fuel costs. All prices based on fuel costs are subject to weekly adjustments based on US Department of Energy On-Highway Diesel Fuel prices. Adjustments to prices will be reflected on the final invoice. Estimates do not include the closure of streets if required. By signing an estimate, you warrant and represent that you are authorized to contract on behalf of Client, that you agree with the terms and conditions of the estimate, that you are authorized to make financial obligations for Client and will, therefore, be invoiced and responsible for full payment of charges.

Insurance:

  • Insurance Policy: Displays Fine Art Services can provide transit and storage insurance for full coverage under the terms of our policy issued by Lloyd’s of London for objects that are professionally packed by either our staff or designated agent. Unless insurance is specifically requested and purchased, the shipper agrees to hold Displays Fine Art Services harmless for any claims of physical loss or damage (irrespective of the cause, including negligence).
  • Certificates of Insurance: Displays Fine Art Services does not include providing certificates of insurance required by property manager(s) in pricing unless otherwise noted.
  • Claims Against Displays Fine Art Services: Displays Fine Art Services shall not be liable for any loss, damage, or delay caused by the act of God, the public enemy, the authority of law, the act or default of the shipper or owner, or for natural shrinkage or damage. Claims for loss or damage must be reported in writing to Displays Fine Art Services. within 30 business days of the delivery date of this shipment, otherwise be deemed waived by the shipper, consignee, and carrier. No claims with respect to a shipment will be entertained until all charges have been paid.


Neon Clause:
Due to the fragile nature, Displays Fine Art Services will not be held liable for any damage occurred during transport, de-installation, packing, and installation of neon glass tubes. Estimate assumes there will be a professional electrician on-site upon installation to install all electrical devices.

Packing: All estimates that include packing services assume that there is adequate space to lay each piece FLAT in order to pack it safely.

Past Due Accounts: If an account is 60 business days or more past due, the following actions will be taken by Displays Fine Art Services:

  • New jobs will not be booked
  • A credit hold will be implemented
  • Client terms will default to pre-pay
  • If a credit card is on file on the account, it will be automatically billed
  • New quotes will not be provided if account is 90 business days or more past due


Payment Terms:
Displays Fine Art Services requires all new clients to pay in full at time of booking. Pending credit approval, all invoices are payable within payment terms according to the date of the invoice. Any invoice not paid within those terms will be subject to late charges of 1.5% per month. Client agrees to pay all reasonable attorneys’ fees, costs and other expenses incurred by Displays Fine Art Services in seeking to collect any amounts due hereunder.

Release of Liability for Third-Party Shipments: Displays Fine Art Services is released of all liability for lost, damaged, or stolen packages for any packages being shipped via FedEx or any third-party shipper. All claims for loss or damage must be submitted to the shipping carrier that was responsible for the transportation of the shipment.

Shipments: All shipments received are subject to the classifications and tariffs in effect on the date of the issue of the corresponding bill of lading, the property described in apparent good order, except as noted (contents and conditions of contents of packages unknown), marked, consigned, and destined as indicated which Displays Fine Art Services, agrees to carry to address designated or to its usual place of delivery at said destination, if on its route, otherwise to deliver to another carrier (the word carrier being understood throughout Displays Fine Art Services contracts as meaning any person or corporation in possession of the property under the contract) on route to said destination. It is mutually agreed as to each carrier of all or any of said property over all or any portion of said route to destination, and as to each party at any time interested in all or any of said property, that every service to be performed hereunder shall be subject to all the terms and conditions as listed herein and the classifications and tariffs in effect on the date of the corresponding shipment. Any individual signing on behalf of the shipper hereby warrants and represents that he or she has authority to contract on behalf of the shipper.

Subcontracting: Displays Fine Art Services has the right to subcontract shipping services.

Taxes: All projects are subject to 8.25% Texas state sales tax unless the billing party is outside of Texas or a tax exemption form has been filled out, returned to, and approved by and is on file with Displays Fine Art Services.

Billing Party Changes: Displays Fine Art Services reserves the right to invoice a change fee for any billing party revisions once a final invoice has been issued.

Weather Conditions: Displays Fine Art Services reserves the right to cancel, postpone, and/or reschedule any and/or all projects due to unsafe conditions as a result of weather, lack of proper equipment or staff due to misinformation from the client, and/or unforeseen circumstances, at no financial cost to Displays Fine Art Services

Exclusive Shipments

Accessibility:  Estimates are based on the accessibility of a 35′ straight truck (overall dims: up to 44′ long and 13′ 6″ in height).

Cancellation/Rescheduling: Displays Fine Art Services reserves the right to invoice a cancelation or rescheduling fee as follows:

  • 15-11 business days – 50%
  • 10 business days or less – 100%
  • If nonrefundable hotels have already been booked at the time of cancellation – 100%

Fabrication

General: Required fabrication lead time is subject to change and will be confirmed at time of booking.

Cancellation/Rescheduling: Displays Fine Art Services reserves the right to invoice a cancelation or rescheduling fee as follows:

  • If fabrication materials have been ordered, fabrication is started, or fabrication is completed at the time of cancellation or revision to the order – 100%.

Fine Art Shuttles

General: To remain cost-effective for clients, Displays Fine Art Shuttle cannot guarantee specific dates or times on Fine Art Shuttle shipments. Weekend collections and deliveries may be required on all shuttles. Displays Fine Art Services will make every effort to accommodate client requests as often as possible.

Accessibility: Estimates are based on the accessibility of a 35′ straight truck (overall dims: up to 44′ long and 13′ 6″ in height).

Cancellation/Rescheduling:

  • 4-5 business days prior to shuttle departure – 50%
  • 0-3 business days prior to shuttle departure – 100%

Late Booking: A $100 Late Booking Fee may apply if booked less than 1 business day prior to shuttle departure

Packing: All items are assumed to be packed by shipper (PBS) unless otherwise stated, requested, or quoted by estimator in writing. If the shipment is packed by owner (PBO) or shipper (PBS), the shipper warrants that the shipment is packed to adequately protect the enclosed goods and to ensure safe transportation with ordinary care in handling, and that each package is properly labeled. The carrier shall not be liable for delay, special or consequential damages.

Wait Time: Estimates include 30 minutes of idle wait time for all shuttle collections and deliveries. Any shuttle collection or delivery that exceeds 30 minutes in idle wait time is subject to re-scheduling and a 100% re-scheduling/cancellation fee

Installation

General: Any installation assumes sheetrock wall, no stairwell, and eye level and estimates do not include installation hardware unless otherwise noted.

Cancellation/Rescheduling: Displays Fine Art Services reserves the right to invoice a cancelation or rescheduling fee as follows:

  • 3 business days – 25%
  • 2 business days– 50%
  • 1 business day– 100%

Line-Haul

Accessibility: Estimates assume collection/ delivery location are tractor trailer accessible.

Cancellation/Rescheduling: Displays Fine Art Services reserves the right to invoice a cancelation or rescheduling fee as follows:

  • 15-11 business days – 50%
  • 10 business days or less – 100%

Storage

General: Displays Fine Art Services requires a 48-hour notice to pull items from storage for pick-up or delivery or additional charges may apply. Any shipment not delivered within 10 business days of pickup will be subjected to the terms and conditions of the Storage Contract and incur storage charges based on current market rate with $100 per month minimum. All outstanding amounts owed by the client must be settled before any items stored with Displays Fine Art Services will be released for delivery.

Cancellation/Rescheduling: Displays Fine Art Services reserves the right to invoice a cancelation or rescheduling fee as follows:

  • 3 business days – 25%
  • 2 business days– 50%
  • 1 business day– 100%

Dock Times: Dock times must be scheduled at least 48 hours in advance of arrival for all collections and deliveries or additional charges may apply. Warehouse Hours: M-F 9AM – 12PM & 1PM – 4PM.
